TERMS AND CONDITIONS

PARTIES

Art. 1. The Terms and Conditions (TC), herein, determine how sifashion.com (the SITE) should be used, as well as the terms and conditions of each digital purchase of items made via the SITE.

Art. 2 (1) The parties of the TC are as follows:
1. „S & I“ Ltd, having their registered address in Sofia, Bulgaria, Lagera, bl.36, fl.6, ap. 39, hereinafter referred to as the SELLER and
2. Every person or legal entity, who has agreed with the TC and who is using the SITE for submitting purchase orders, hereinafter referred to as the USER
(2) The Seller and the User are hereinafter jointly referred to as the Parties.

SCOPE

Art. 3. The Seller presents to the User a catalogue of items and the User can purchase one or more items offered on the SITE. The purchase shall be made by submitting an order and paying the price of the items, in accordance with the TC herein and the additional conditions set for the items, if any.

ACCEPTING THE TC

Art. 4. (1) By registering in the SITE or simply by using the SITE, the USER is making a digital statement by means of the Digital signature and Digital document Act. With the latter statement the User state that he/she is aware of the TC herein, he/she accepts it and shall not break them.
(2) The Seller immediately confirms the receipt of the statement set in Art. 4 para 1, and sends a message to the email of the User which includes the personal data of the Seller as well as the text of the TC herein, or a link to it.

Amendments TO THE TC

Art. 5. (1) The TC herein, can be unilaterally amended by the Seller.
(2) If any amendments are made, the Seller shall put on a prominent place on the SITE a link to the amended TC
(3) The amendments in the TC does not affect any purchase deals which are validly made before the notification set in para 2 above.

CATALOG OF THE ITEMS

Art.6 (1) The items are set in offers, sorted in different order, either according to the the User s needs or to the SITE s default sorting.
(2) Each offer includes basic information about the item: according to its type and its price. The offers include pictures of the items.
(3) The price showed, is only for one item. The price do not include the delivery expenses.
(4) Any additional conditions regarding the ordering process and delivery process are set in the SITE separately.

ORDER AND DELIVERY OF THE ITEMS

Art. 7 (1) The order is made by filling out an order form, located in the SITE
(2) The User shall provide accurate personal data of the person who will receive the delivery as well as the exact place of delivery.
(3) The type, the quantity and the end price (VAT included) are calculated in the order automatically upon adding an item to the shopping cart.
(4) Ordering of an item is made by pressing the button „Buy Now”, located next to each item in the catalogue. This action represents the will of the User to purchase the selected item and this action establishes a legal relationship between the Parties. This legal relationship is regulated by the TC herein and the provisions of the Protection of Consumers Act.
(5) After receiving the Order, the Seller shall contact the User by phone or by email. The User shall confirm the Order that he/she has made.

DELIVERY CONDITIONS

Art. 8 The delivery conditions are as follows:
1. The item(s) are delivered to the address indicated in the order form. The User shall provide free delivery access to the latter address.
2. The ordered item shall be delivered within 3 days to the address indicated in the order form if the address is full and valid.
3. The item shall be delivered in appropriate package according to the type of the item and the transportation used.
4. If the User cant be found within the delivery term, or the User cant provide free access to the delivery address, the order shall be considered as cancelled. In the latter case the Seller does not bear liability for not fulfilling the delivery.
5. If the User confirms the order, even if the delivery term has been expired, and even if the User was no found on the delivery address, the User shall reimburs the expenses for the new delivery. The expenses for the new delivery shall be reimbursed when the items are delivered to the User.
6. If the delivery is being received by a third party, the person who has made the order shall not have the right to return the item or to make any objections about the item.

DELIVERY CANCELATION AND REJECTION OF ITEMS

Art. 9 (1) The User who has ordered the item from the SITE shall have the right to refuse the item in the following cases:
1. If the item does not match exactly the item specified in the order form. The latter discrepancies should be easily proved by usual review of the item.
2. If the package of the item is damaged during the transportation
3. If the price of the item differs from the price set in the offer in the SITE.
4. If the delivery term is not fulfilled.
(2) Any claims on the grounds of the points above shall be made only when the delivery is made.

Art.10 Except the conditions above, the User shall not have the right to cancel a delivery or to reject an item, ordered by him. If so, the User shall pay the expenses for the delivery and shall return the item to the Seller.

Art .11 If a delivery cancellation or an item rejection is made, the parties shall make a protocol at the moment of delivery. If the User refuses to sign the protocol, the rejection of the item or the cancellation of the delivery are unjustified, therefore the User shall reimburse the delivery expenses and return the item to the Seller.

Art. 12 After acceptance of the delivery, if the User has found defects in the item he/she can claim the price back and return the item to the Seller in the following cases:
1. If the item has a major defect, which couldnt be found during usual review of the item
2. If during the use of the item, a major defect is discovered which prevents the item from usual use.

Art. 13. The claims are accepted by the Seller as follows:
1. On the grounds of point 2 of Article 12: within 24 hours from the delivery
2. On the grounds of point 1 of Article 12: within 7 days period, starting from the moment of delivery, if both the item hasnt been used and it is returned in the condition as it was received.

Art. 14. If there is a discrepancy between the item which is received and the item, which is ordered, and that discrepancy cannot be found in the moment of delivery, the item shall be replaced within 24 hours after the User has claimed the discrepancy and the Seller has performed a review of the item.

PAYMENTS

Art. 15 The payment for the ordered items shall be performed as follows:
1 Upon delivery: the payment is made upon delivery of the item. The price shall be paid in cash to the courier.

INFORMATION CONFIDENCIALITY

Art. 16. The Seller shall not reveal any personal information of the User. The Seller shall not deliver the personal information of the User to a third party: state authorities, companies, person or others except in the following cases:
1. if the Seller has received the explicit consent of the User during the registration in the SITE or in a later moment
2. the information is required by state authorities, which according to the Bulgarian legislation, are authorized to require such information;
3. in other cases, specified in the Bulgarian laws.

RESTRICTIONS

Art. 17 (1) The User shall have the right to use freely the SITE s resources, in accordance with the regulations of the TC herein, and other legal regulations.
(2) The User of the SITE shall have no right to copy, to distribute and to use text, images or parts of the SITE without the explicit consent of the Seller.
(3) The User shall not have the right to overload the SITE with fake inquiries or any other information.
(4) The User of the Site shall have no right to perform actions which are breaking the rules of communication, to perform malicious actions, to distribute viruses etc. and any other actions infringing third party s rights..
